The Notarial Council is preparing to sign a collaboration agreement to integrate notary offices into the GEISER application, managed by the State Agency for Digital Administration under the Ministry for Digital Transformation. This move aims to resolve a longstanding technological conflict between public administrations and the notary sector. Official confirmation of the agreement is pending.

GEISER is the system used by the Administration to manage official entry and exit records, as mandated by Article 16 of Law 39/2015. It would allow citizens and businesses to interact with notary offices through the State General Electronic Registry, part of the SARA network, to submit any legal requests.

The integration relies on SIR (Spanish: oficinas SIR), or Service for Interconnected Registry Offices. These offices would handle digitalization, issue authentic electronic copies, and manage registry entries, functions previously unattainable due to lack of integration with DIR3, the Common Directory of Organizational Units and Offices, a prerequisite for operating in the digital environment.

The College of Registries established a precedent in 2022 by signing an agreement with the then General Secretariat of Digital Administration and the Ministry of Justice for SIR use, published in BOE No. 253 on October 21, 2022. This aligns with the reuse of existing solutions mandated by Article 157.3 of Law 40/2015 and the National Interoperability Scheme.

Two conditions must be met for this process: access to the SARA network, which the notary colleges currently lack despite Madrid and Sant Cugat tech centers having direct access via the Justice network; and registration in DIR3, with no evidence of such registration yet. Responsibility for the integration remains unclear—whether it will be handled by the Notarial Technological Center or GEISER’s cloud service offered by the Ministry.

This is not a minor change. Since the Notarial Law of 1862, there has been no precedent for the notary sector participating in the General Administration’s technological infrastructure. The agreement could set a precedent for full integration of notaries into DIR3 and GEISER, a step that, as a state mandate, should be undertaken with the responsibility inherent to public service.

Further developments will be monitored.
